Some of the data is collected to ensure that the website is made available to you without errors. Other data can be used to analyze your user behavior.
What are your rights when it comes to your data?
You have the right to obtain free access to the origin, recipient, and purpose of your saved personal data at any time. You also have the right to request that this data be rectified, blocked, or erased. If you have any questions about this or any other aspects of data protection, please do not hesitate to contact us at any time at the address stated in the legal notice. Furthermore, you have the right to lodge a complaint with the relevant supervisory authority.
Under certain circumstances you also have the right to request that the processing of your personal data be restricted. Details on this are provided in the data protection declaration under "Right to restrict data processing".
ANALYSIS TOOLS AND TOOLS FROM THIRD-PARTY PROVIDERS
When you visit our website, your browsing behavior may be evaluated statistically. This is mainly done using cookies and what are known as analysis programs. Your browsing behavior is generally analyzed anonymously; i.e. your browsing behavior cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. Detailed information about this is available in the following data protection declaration.
You can object to this analysis. We will inform you of the ways in which you can lodge an objection in this data protection declaration.
2. GENERAL NOTES AND MANDATORY INFORMATION
The operators of this website take the task of protecting your personal data very seriously. We handle your personal data confidentially and in accordance with both the legal data protection regulations and this data protection declaration.
A range of personal data is collected when you use this website. The term 'personal data' refers to data that could be used to personally identify you. This data protection declaration explains which data we collect and what we use it for. It also explains how we do this, and for what purpose.
We should like to point out that there may be security vulnerabilities when transmitting data over the Internet (e.g. when communicating via e-mail). It is not possible to completely protect data against access by third parties.
NOTE ON RESPONSIBLE PARTY
The party responsible for the data processing on this website is:
KIX Service Software GmbH
09113 Chemnitz, Germany
Telephone: +49 371 27095 620
The term 'responsible party' denotes the natural or legal person who decides, either alone or together with others, on the purposes and means for processing personal data (e.g. names, e-mail addresses, etc.).
REVOKING YOUR CONSENT TO THE PROCESSING OF YOUR DATA
Many data processing transactions cannot be performed unless you give your express consent. If you have previously given your consent, you can revoke it at any time. To do so, simply e-mail us accordingly with your request. No formal requirements apply in terms of how to formulate this e-mail. The legality of the data processing performed up until the point you revoke your consent remains unaffected by the revocation.
RIGHT TO OBJECT TO THE COLLECTION OF DATA IN SPECIAL CASES AND TO DIRECT MARKETING (ART. 21 GDPR)
You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. The respective legal basis underpinning the processing of your data can be found in this data protection declaration. If you lodge an objection, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims (objection according to Art. 21(1) GDPR).
Where your personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. If you lodge an objection, your personal data will then no longer be used for direct marketing purposes (objection according to Art. 21(2) GDPR).
RIGHT TO LODGE A COMPLAINT WITH THE RELEVANT SUPERVISORY AUTHORITY
If the GDPR regulations are breached, the data subject has the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their workplace, or the location of the suspected breach. The right to lodge a complaint exists regardless of any other administrative or legal judicial remedies.
RIGHT TO DATA PORTABILITY
Where we process data by automated means on the basis of your consent or to fulfill a contract, you have the right to have this data handed over to you or to a third party in a commonly used and machine-readable format. If you request that the data be transferred directly to another controller, this will only be carried out insofar as it is technically feasible.
SSL OR TLS ENCRYPTION
This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential information, such as orders or inquiries, that you send us as the website operator. You can tell that a connection is encrypted by the fact that the URL bar in your browser shows "https://" instead of "http://" and by the padlock icon in your browser bar.
If SSL or TLS encryption has been activated, the data that you send us cannot be read by third parties.
ACCESS, BLOCKING, ERASURE, AND RECTIFICATION
Within the scope of the applicable legal provisions, you have the right, at any time, to obtain free access to your saved personal data, its origin and recipient, and the purpose of the data processing, and if applicable a right to rectification, blocking, or erasure of this data. If you have any questions about this or any other aspects of personal data, please do not hesitate to contact us at any time at the address stated in the legal notice.
RIGHT TO RESTRICT DATA PROCESSING
You have the right to request that the processing of your personal data be restricted. For this purpose, please contact us at any time at the address stated in the legal notice. You have the right to request that data processing be restricted in the following cases:
If you dispute the accuracy of your personal data that we have saved, we generally need some time in order to check this. You have the right to request that the processing of your personal data be restricted for the duration of this check.
If your personal data was/is being processed unlawfully, then instead of the data being erased you can request that the data processing be restricted.
If we no longer require your personal data, but you require it in order to exercise, defend, or assert legal claims, then instead of the data being erased you have the right to request that the processing of your personal data be restricted.
If you have lodged an objection in accordance with Art. 21(1) GDPR, then it is necessary to weigh your interests against our interests. You have the right to request that the processing of your personal data be restricted as long as it remains unclear whose interests prevail.
If you have restricted the processing of your personal data, then with the exception of storage, this data is only permitted to be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

4. RECORDING OF DATA ON OUR WEBSITE
In some cases, web pages use what are known as cookies. Cookies do not damage your computer and do not contain any viruses. Cookies are used to make our offer more user-friendly, effective, and secure. Cookies are small text files which your browser saves on your computer.
Most of the cookies we use are what are known as session cookies. They are deleted automatically once your visit to our website is over. Other cookies remain saved on your device until you delete them. These cookies enable us to recognize your browser the next time you visit our website.
You can configure your browser to inform you when cookies are set, to permit cookies in individual cases only, to exclude the acceptance of cookies in specific cases or generally, and to activate the option to automatically delete the cookies when you close your browser. If cookies have been deactivated, the functions of this website may be impaired.
Cookies that are required to perform electronic communications or to provide certain features that you desire (e.g. basket function), will be saved on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the storage of cookies in order to provide its services correctly and in an optimized way. If other cookies (e.g. cookies to analyze your browsing behavior) are saved, they will be handled separately in this data protection declaration.
SERVER LOG FILES
The website provider automatically collects and saves information in what are known as server log files, which your browser sends us automatically. This information is:
Browser type and browser version
Operating system being used
Host name of the computer accessing the page
Time of the server request
This data is not combined with data from other sources.
This data is recorded on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in displaying its website correctly and optimizing it – this is the reason for recording the server log files.
If you send us inquiries using our contact form, we will save your information from the inquiry form, including the contact details you state therein, in order to process your inquiry and for any follow-up questions. We will not pass on this data without your consent.
As a result, the data entered in the contact form will be processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time. To do so, simply e-mail us accordingly with your request. No formal requirements apply in terms of how to formulate this e-mail. The legality of the data processing transactions performed up until the point you revoke your consent remains unaffected by the revocation.
We will retain the data you entered in the contact form until you request us to erase it, until you revoke your consent to the storage of the data, or until the purpose for storing the data ceases to apply (e.g. once your inquiry has been fully processed). Mandatory legal provisions – in particular retention periods – remain unaffected by this.
DATA Processing (CUSTOMER DATA AND CONTRACT DATA)
We collect, process, and use personal data only to the extent necessary for establishing, substantiating, or modifying the legal relationship (existing data on existing customers). This is based on Art. 6(1)(b) GDPR, which permits data to be processed for the purpose of fulfilling a contract or pre-contractual measures. We collect, process, and use personal data regarding the use of our website (usage data) only where this is necessary to enable the user to use the service or to bill them for their use of the service.
The collected customer data is erased once the order is complete or the business relationship has come to an end. Legal retention periods remain unaffected by this.
Data processing (Newsletter)
As soon as you register for our newsletter, we will use your email address to send you the requested information on a regular basis. The legal basis is your consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO.
To ensure your proper registration for the newsletter, we will send you a confirmation e-mail after your initial registration in the DoubleOpt-In procedure, in which we ask for confirmation of the registration. This is to prevent unauthorised registration on behalf of third parties.
In connection with your registration for the newsletter, we also store your registration data (e.g. e-mail address, date and time of registration/confirmation of opt-in) so that we can trace and prove the registration at a later date.
The legal basis for this storage is a legitimate interest, Art. 6 para. 1 p. 1 lit f, Art. 7 para. 1 DSGVO. The legitimate interest is based on the obligation to prove consent.
Your email address will be stored for the newsletter mailing until you unsubscribe from the newsletter or until we stop sending the newsletter to you.
You can revoke your consent to receive newsletters from KIX Service Software GmbH in the future at any time. To do so, use the unsubscribe link at the end of each newsletter. Alternatively, you can send your request to unsubscribe from the KIX newsletter to email@example.com.
5. ANALYSIS TOOLS AND MARKETING
Use of web tracking
Our website uses Google Analytics, a web analysis service from Google Inc. ("Google"). Google Analytics uses what are known as "cookies": text files that are stored on your computer to analyze your use of the website. The information generated by the cookie concerning your use of this website is generally transferred to a Google server in the USA and stored there. However, if IP anonymization has been activated on this website, Google will truncate your IP address beforehand within Member States of the European Union or in other States party to the Agreement on the European Economic Area. The full IP address will only be transferred to a Google server in the USA and truncated there in exceptional cases. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to draw up reports about the website activities, and to provide other services associated with the use of the website and Internet for the website operator.
The IP address transmitted by your browser as part of Google Analytics will not be combined with other Google data. You can prevent cookies being stored by configuring your browser software accordingly; however, we should like to point out that, if you do so, you may not be able to use all the website's functions in full. Furthermore, you can prevent the recording and transfer of the data generated by the cookie and relating to your use of the website (incl. your IP address) to Google as well as the processing of this data by Google, by downloading and installing the browser plug-in available under the following link (http://tools.google.com/dlpage/gaoptout?hl=de).
You can prevent the recording of data by Google Analytics by clicking on the following link. An opt-out cookie will then be set, which prevents your data being recorded when you visit this website in the future: Deactivate Google Analytics.
We should like to point out that, on this website, Google Analytics has been expanded to include the code "gat._anonymizeIp();" in order to ensure anonymized recording of IP addresses (what is known as IP masking).
Contracted data processing
We have concluded a contract on contracted data processing with Google and fully implement the stringent requirements set by the German data protection authorities regarding the use of Google Analytics.
